Photography Submissions Invited: Ensure Copyright Compliance Before You Send

We are excited to announce that our readers are welcome to send their best photos to [email protected] for potential publication in our newspaper and on our website. However, it's crucial to remember that copyright regulations apply when submitting images.

Before publishing, you must obtain the copyright holder's permission, especially if the photo was created by someone other than the submitter. If the photo is under a Creative Commons (CC) license, you must comply with the specific terms, such as attribution, linking to the license, and noting changes if applicable.

Photos created by yourself or those showing subjects not protected by copyright (e.g., general views, nature) are typically safe to submit. However, photos of copyrighted artwork or property may require specific clearance. If you cannot identify or contact the copyright holder (an "orphan work"), some jurisdictions allow you to purchase a license after conducting a "diligent search," which indemnifies against copyright risk.

Simply acknowledging the source or providing credit does not replace the need for permission unless the use falls under fair use or similar exceptions, which are limited and situation-specific. If submitting photos found online, ensure they are either your own work, in the public domain, or appropriately licensed for reuse; linking to images rather than copying may avoid copyright infringement.

In summary, when submitting photos, confirm that you own the copyright or have explicit permission/licensing to submit the photo. Provide attribution and license details if under Creative Commons or similar licenses. Avoid using images without permission unless they are clearly in the public domain or permissible under fair use, keeping in mind this is a narrow and sometimes unclear exception.
